| 摘 要： | 因著作权侵权情形严重,必须完善立法加强对著作权人的保护。完善的立法需要科学的理论为基础,著作权侵权行为的性质与特征是一个需要明确的理论问题。著作权侵权行为在性质上应为特殊侵权行为,因为其符合法律对特殊侵权行为的认定标准,有利于切实保障著作权人的合法权益及制裁侵权行为。著作权侵权行为五个方面的特征是:侵权形式上的特殊性;法律适用上的严格地域性;侵权对象的多重性;侵权形式的多样性及侵权行为的隐蔽性。

| Abstract: | It must perfect the legislations to strengthen the protecting to the copyrighter for the serious infraction.The perfect legislations need the basis of scientific theories.The natures and characters of the copyright-infringement actions is a theory to clarify.The copyright-infringement action must be the special the copyright infringement,because it accord with the cognizance law-standards;it favors for guarding the legal rights of the Copyrighter and cracking down on the infringement actions.It discusses five characters of the infringement-actions: the particularity of the infringement form;the grimly region of the law-applied;the multilayer of the infringement form;the diversity of the infringement form;the concealment of the infringement action. |
