| 摘 要： | 随着司法实践的逐步发展,近年来学校教育管理与惩戒的合法性日益受到人们的质疑,要求加强司法审查的舆论呼声日趋高涨。学校教育惩戒的合法性审查必须包括价值原则的审查与重构,而学校教育惩戒所应奠基的三个价值基础是:正义、秩序与教育性。

| Abstract: | Nowadays, with the development of judicatory practice, the legitimacy of school management and educational discipline is being questioned and the public calls for the judicial review more and more. The legitimacy examination of school discipline should involve the examination and reconstruction of value principles and the three basic values of school discipline are justice, order, and education. |
