| Abstract: | The supervision compensation is both a supervisory tool to force the exercise of supervisory power in accordance with the law,and a relief channel for the applicants concerned to initiate their rights to seek state compensation. Therefore, the construction of the supervision compensation system not only has the value connotation of safeguarding human rights and limiting public power, but is also a practical need to achieve a smooth interface between the Supervision Law and the State Compensation Law in accordance with the norms of the Constitution. The supervisory committee is, in its essence, a supervisory organ. The state compensation system for infringement of the rights and interests of citizens, legal entities and the other organizations by the supervisory organs and their staff due to the exercise of their powers should be in line with the special mode of operation of the supervisory power. That is, a relatively independent type of supervision compensation should be constructed separately from the existing state compensation system. In terms of the normative design, it is of great importance to establish the principle of liability with the violations of the law as the main responsibility, and the result liability as a supplement, to clarify the compensation scope covering personal rights, property rights and mental impairment,to properly determine the organ liable for compensation and the applicant in combination with the substantive and formal elements, and to construct a procedural mechanism of compensation that the supervisory organs goes before the courts, so as to achieve a balanced operation between the exercise of supervisory power and the protection of rights. |
