| 摘 要： | 沉默权制度的确立在当代中国面临着种种难题,主要表现为沉默权自身的矛盾,法制运动的理念先导与实践滞后的矛盾,沉默权与我国文化差异的矛盾,制度创新中价值取向之间的矛盾,沉默权与诉讼模式传统影响的矛盾等。这些矛盾的存在使得我国在确立沉默权制度上步履蹒跚,我们对此应充分认识并努力创造主客观条件解决它。

| Abstract: | Right to silence has been discussed a lot in China,but how to establish the system of right to silence has been faceding a lot of difficulties. The main difficulties are: the self-contradiction of right to silence;the contradiction between the advanced idea of law movement and laggard practice; the contradiction between right of silence and our traditional culture; the contradiction between different directions to value during the initiation of system; the contradiction between right to silence and the traditional effect of procedural mode. All these contradictions restrain the establishment of right to silence in out country. We should recognize all these very well and create both objective and subjective conditions to solve it. |
