| 摘 要： | 我国建立了与社会主义市场经济体制相适应的法律制度，使我国的物权保护能力得到强化。但，进一步充分发挥物的效用，推动经济社会实现科学发展，还应充分吸取古今中外法治文明的优秀成果，积极完善民法对物权的确认，返还原物，消除危险、排除妨害，修理、重作、更换或恢复原状，损害赔偿和其他民事责任等请求权的具体保护措施，科学构建民法的现代物权保护制度，使民法的物权保护机制更加适应经济社会科学发展、构建社会主义和谐社会的需要。
