| 摘 要： | 深厚的文化基础是刑法的力量源泉之一。犯罪是社会反主流文化与主流文化严重冲突的表现；刑罚是社会主流文化限制和取缔反主流文化的表现形式之一。当代中国，犯罪是传统文化中的封建文化、计划经济模式下形成的文化、外来文化和亚文化与社会主义文化严重冲突的表现；刑罚是社会主义文化限制和取缔传统文化中的封建文化、计划经济模式下形成的文化和外来文化的表现形式之一。它们共同构成了当代中国刑法生命力的文化内涵。

| Abstract: | The thick cultural foundation is one of the power sourses of criminal law.Crime is the reflection of violent conflicts between the counterculture and the mainstream of culture in a soceity.Punishment is one of the reflections of the mainstream of culture which limits and suppresses the counterculture in a society.Currently in China,crime reflects the result that the feudal cultrue of traditional culture,the culture formed in the model of planned economy and the imported culture conflict with the socialistic culture.Punishment is one of the reflections of the socialistic culture which limits and suppresses the feudal culture of traditional culture,the culture formed in the model of planned economy culture and the imported culture.They compose the cultural limplication of the vitality of criminal law as well in contemporay China. |
