| 摘 要： | 高等教育治理能力主要体现在对人的自主性和创造力的提升、高等教育资源的有效配置以及高等教育相关事务的恰当处理等方面。当下高等教育治理不尽如人意的一个症结是高等教育法治化水平不高。中国应当针对体现高等教育治理能力的几方面事务,加快提升高等教育法制建设水平,特别是完善高等教育法律制度体系、科学设计高等教育法律法规的内容和增强高等教育法律规范的可操作性,加大高等教育依法治理的教育培训力度,强化高等教育依法治理的评估与监督。

| Abstract: | The capacity of higher education governance is mainly reflected in the improvement of human autonomy and creativity, the effective allocation of higher education resources, and the proper handling of higher education related affairs. There are still many problems in these aspects in today’s China and the main reason lies in the inappropriate higher education legalization level. In response to several issues that reflect governance capabilities of higher education, China should accelerate the improvement of legal system construction level in higher education, especially the improvement of higher education legal system, scientifically designing the content of higher education laws and regulations, enhancing their operability, strengthening the education and training of legal governance of higher education and improving the evaluation and supervision of legal governance on higher education. |
