| 摘 要： | 立法主体在法律文本中的授权立法条款是将与该法相配套性法规范性文件的制定权力授予其他立法主体行使的条款。一般来讲,作为完整的授权立法条款应包括授权主体、授权客体以及授权事项的内容。在现行我国的法律文本中,不论是在法的总则、法的分则、法的附则中都可能存在该条款的设置,当然涉及的授权事项有所差别。我国在授权立法条款的设置上存在的问题如授权立法的必要性问题、授权立法的标准、授权立法的效力等级等方面需进一步改进和完善。

| Abstract: | The authorized legislative clause of the legislature in the legal text refers to the clause which authorizes the corresponding power of legislation to other legislatures.Generally speaking,a complete authorized legislative clause should include the authorized subject,the authorized object,and the authorized task.In the existing legal text of China,often is the case that there is the enactment of such clause in the general provisions of the law,the specific provisions of the law and the supplemental provisions of the law with different focuses and items.The enactment of China’s authorized legislative clause needs improvement in terms of the legality,criteria and validity of authorized legislation. |
