| 摘 要： | 民事责任是破产管理人承担法律责任的主要方式。破产管理人民事责任的性质应为侵权责任；在归责原则上，破产管理人的民事责任应适用过错责任原则；在破产管理人侵害债权人一般利益的情况下，法律应令监督人代理全体债权人进行民事诉讼；破产管理人为数人时，责任的承担应与其执行职务的方式联系起来。

| Abstract: | Civil liability is the key form of legal responsibility of bankruptcy trustee.The nature of the civil liability of bankruptcy trustee should be that of tort. According to doctrine of liability fixation doctrine of liability for wrongs applies to the civil liability of bankruptcy trustee.Under conditions that the general interests of creditors are tespassed upon by bankruptcy trustee.Law should order the supervisor to take civil action for all the creditors,When there are several bankruptcy trustees they should share their responsibility according to the work they are in charge of. |
