| 摘 要： | 实践中对于酒驾肇事的行政执法不尽统一,类似案件司法审判结果也不尽一致。分析酒驾肇事所涉及的法律法规,对醉酒驾车导致重大伤亡事故以危险方法危害公共安全罪定罪量刑值得商榷。合法有效预防和打击酒驾行为,建议加强交通行政执法,统一司法审判,完善相关立法。在刑法中增设＂危险驾驶机动车罪＂有现实的必要。

| Abstract: | In judicial practice,there are divergences in the administrative law enforcement concerning such cases and the outcomes of trial justice are not consistent.This paper analyzes the laws involved in the cases of intoxicated driving and believes that convicting the offenders of drunk driving leading to heavy casualties of ＂endangering public safety in a dangerous way＂ is questionable.To legally and effectively prevent and combat drunk-driving behavior,it is proposed to strengthen the administrative law enforcement on traffic,unify administration of justice and improve the relevant legislation.In addition,there is real a need to add ＂dangerous motor vehicle-driving crime＂ to criminal law. |
