| 摘 要： | 虐猫事件反映出人们道德观念上对于动物保护的关注,突显出法律调整对于动物保护方面的空白,而该事件背后的“网络力量”,更引发了对于法律与道德界限的再思考。法治社会的法律需要具备最低限度的道德精神,法律规范需要反映社会民众的基本道德标准;同时,法治社会必须崇尚法律权威,以法律为社会控制的首要力量,这才是法治的应有之意。

| Abstract: | The whole "Cat Abused Incident" reflects people's ethical attention towards the protection of animal's rights,and also reveals the vacuity of law at this area.The "network power" behind the incident reminds us to give reconsideration to the boundary between law and morality.The legislation in the society ruled of law should have a minimum of ethical spirit and its legal norms should reveal the basic ethical standards of the social community.Meanwhile, a society ruled by law should advocate legal authority and make law the primary force of social control,which is the due meaning of the rule of law. |
