| 摘 要： | 伴随着社会转型的脚步,近代中国的法制现代化也发生着剧烈的变革并呈现出其独特的特征:法制创新与民族主义情绪的结合;政府的主导性;法制改革的被动性;法制现代化运动带有明显的功利主义和实用主义的色彩;法律制度的半殖民地半封建性。

| Abstract: | Along with the steps of social transformation,legality modernization in modern China also has sharp revolutions and presented unique characteristics: the integration of legality innovation and nationalism feeling,dominance of government,passivity of legality reform.Legality modernization movement has the color of apparent utilitarianism and pragmatism,the semi-colony and semi-feudal legality system. |
