| 摘 要： | 沉默权即反对自我归罪特权,在世界上绝大多数国家的立法中均有规定,而我国对这一制度的立法选择争论已久。本文在总结我国现行法对沉默权态度的基础上,提出设立沉默权是适合我国现实国情、适应法治建设实际需要的观点。

| Abstract: | The so called right to keep silence is that you have the privilege to opposite yourself against acknowledging that you are responsible for the crime.It is laid down in the regulations of majority countries in the world. While in our country, the discussion on legislation choice of this regulation has been lasting for a long time. The article puts forward the point that it is required by the practical condition of china and development of legal system to lay down the right to keep silent, which is generalized on the basis of the attitude of the present law to that right. |
