| 摘 要： | 墨子和以他为代表的墨家,适应当时公布成文法的社会发展大趋势,在他们“兼相爱、交相利”的主体思想构架下,站在“贱者”、“弱者”、“贫者”等下层劳动者的立场上,通过展开对维护“贵者”、“强者”、“富者”利益的奴隶主贵族统治制度的批判,提出了兼爱、兼利、以天为法、“劝爱禁恶”、赏当贤、罚当暴等独具特色的法律思想。

| Abstract: | Mozi and the Mohist School adapted themselves to the social trend of issuing the red-made law, maintained the main thought framework of "love all the people and benefit them", and took the stand of the labors with lower social status. By criticizing the noble slaver ruling system that safeguarded the benefits of the upper society, they put forward a series of legal thoughts. |
