| 摘 要： | 商业秘密是指不为公众所知悉、能为权利人带来经济利益、具有实用性并经权利人采取保密措施的技术信息和经营信息。TRIPS协定对保护商业秘密作出了明确的规定。国际社会已高度重视对商业秘密的法律保护，我国初步形成了对商业秘密保护的法律体系。必须高度重视商业秘密流失的严重性。从制度建设上防范和杜绝商业秘密流失，切实依法保护商业秘密。

| Abstract: | Business secrets refer to the practical information of technology and operation unknown to the public on which the obligee takes secrecy measures and which can bring economic benefits to the obligee. The protection of business secrets is definitely stipulated in TRIPS agreement. The legal protection of business secrets has been highly emphasized by the international society and the legal system of business secrets protection has been established initially in our country. The severity of business secrets loss must be taken high attention to and business secrets loss must be safeguarded and stopped in the light of systematic construction in order to protect business secrets in accordance with law conscientiously. |
