| 摘 要： | 网络技术的飞速发展，给传统的著作权保护法律体系带来了极大的挑战，作为著作权保护法律体系核心和基础的复制权，必须适应网络环境的发展。在我国复制权的发展道路上有三个不可回避的问题：第一是作品数字化问题，它是探讨复制权发展的逻辑起点；第二是暂时复制问题，这是我国乃至世界范围内讨论的焦点问题；第三是权利限制问题，其是“利益平衡”这一著作权法律体系根本立法原则的集中体现和贯彻。

| Abstract: | The rapid development of the network technology has posed great challenge on traditional legal system of intellectual property rights.The duplication rights as the basis and core of legal system in protection of copy rights must meet the need of development under the network environment.There are three problems which can't be avoided on the road of the development of duplication rights.Firstly,it is the problem of digitalization of works,which is the logical starting-point of analysis in development of duplication;secondly,it is the problem of temporary duplication,which is a central issue in China so far as to all round the world;The last one is the limitation of rights,which is the concentrated reflection and application of the ultimate principle of the balance of profits in the legal system of the protection of copyrights. |
