| 摘 要： | 建构在德国学者萨维尼“法律关系本座说”与英国学者戴西“既得权说”基础之上的传统冲突规范,在进入20世纪30年代后遭到学者的批判,在历经半个世纪的洗礼和锤炼后,发生了蜕变,形成了新型的现代冲突规则。现代冲突规则本身涵盖了稳定性与灵活性、判决的一致性和个案公正性、法律适用中形式正义与实质正义等多元价值理念,对中国现行冲突立法的完善具有重要启示作用。

| Abstract: | Traditional conflict rules,which were based on Sitz des Rechtsverhaeltnisses and the doctrine of vested rights,received severe criticism in 1930s.But after half a century,they experienced a qualitative change and have formed new types of modern conflict rules.Modern conflict rules contain multiple values,such as stability and flexibility,consistency of decision and justice of individual case,form justice and material justice in law practice,which play an important role in improving China's legislation of conflict rules. |
