| 摘 要： | 刑法解释赋予刑法条文以生命。刑法学界对刑法解释的理解存在着诸多争议,争议的焦点集中表现在刑法解释的主体、对象和视角等方面。在建设法治国的背景下,遵循刑法的基本理念,刑法解释是指解释者在刑法条文文句所能涵盖意义的限度内,阐明刑法条文的语言意义和内在真意。刑法解释也是对刑法立法合理性的检验,由此引导我们发现问题,解决问题。

| Abstract: | Criminal law interpretation gives life to criminal law clauses.There are many contentions about the subject, object and visual angle of criminal law interpretation. According to the idea to rule by law , criminal law interpretation means that interpreter explains the literal sense or essential meaning of criminal law clauses within the limits of the meaning of words. Also criminal law interpretation can examine the rationality of criminal law and give us a lead in finding and solving problem. |
