摘    要:现实生活中,有时会出现夫妻一方擅自处分共有房屋的情形.此时,如果第三人是善意的,他能否取得该房屋的所有权.这涉及到不动产善意取得制度、家事代理权以及居住权和交易安全的冲突问题.笔者试从这三个角度出发,参照世界各国的立法例和我国现行的法律规定,对此进行论述.

Abstract:In actual life,a spouse without authorization appears to punish the situation of owning the house in common without authorization sometimes.At this moment,if the third person is well-meaning,he could obtain the ownership of this house.This involves real estate and obtains the system,family matters attorneyship and inhabits the conflict question with safe right and trade with good intention.I try proceeding from these three angles,consult the legislative examples of the countries all over the world and our country's current legal provisions,as to this describe.
