| 摘 要： | 从现实司法实际中日益增多的代表人诉讼案件入手，以代表人诉讼相关的基本概念为基础，通过分析我国立法中有关代表人诉讼的规定，联系司法具体操作中存在的缺陷和不足对其程序操作中几个应重点把握的方面，如管辖等提出了自己一些不太成熟的看法，以期为今后代表人诉讼制度的日趋完善起到促进作用和达到抛砖引玉的效果。
