| 摘 要： | 非物质文化遗产与知识产权同属于人类智力创造的产物,对非物质文化遗产通过知识产权制度进行保护是有可能也是有必要的。河南非物质文化遗产非常丰富,许多非物质文化遗产知识产权归属相对明确,具有一定的市场价值,可以通过知识产权制度保护产权主体的合法权益,防止对非物质文化遗产的不正当使用,还可以对公权力进行抑制和监督,实现非物质文化遗产的保护与保存。我们还要适应非物质文化遗产特点,不断完善知识产权特别保护制度。

| Abstract: | Intangible cultural heritage and intellectual property rights belong to product of the creation of human intelligence,on intangible cultural heritage through the intellectual property rights protection system is also may be necessary.Henan intangible cultural heritage is very rich,many intangible cultural heritage intellectual property ownership relatively clearcut,has certain market value,can through the intellectual property rights protection system of the main body of property rights legal rights and prevent the intangible cultural heritage of the improper use,also can undertake inhibition and supervision of public power,and realize the intangible cultural heritage protection and preservation.We have to adapt to the intangible cultural heritage characteristics,and constantly improve the intellectual property special protection system. |
