| 摘 要： | 1994年拍摄的电影<被告山杠爷>讲述了人称"山杠爷"的四川省堆堆坪村村支书治村有方,身受百姓爱戴,然而执法严厉,最终被人举报,公安机关认为其执法手段违反法律而将其强行带走的事件.影片折射出在社会转型时期,传统的执法意识与现代执法规则发生的碰撞.步入新世纪,面对社会对规则、程序、正义等价值越来越深层次的追求,传统执法手段自身面临严重危机.剖析该影片的主旨,分析其法理学内涵,有利于重新审视传统执法手段的利与弊,从而去其糟粕,取其精华,为新时期新社会条件下的立法与执法活动提供借鉴.
