摘    要:文章从大学生打工是否受劳动法保护这一问题入手,通过对大学生用工中的相关称谓的辨析,以及对相关法律规定的曲解重新予以澄清,进而认为在校大学生有资格成为劳动法意义上的劳动者,打工大学生与用人单位之间建立的是劳动关系,应耋受到劳动法的保护,并且提出了进一步规范大学生自主打工行为的相关建议。

Abstract:This paper discusses whether college undergraduates should be protected by labor law when doing a part - time job, analyzes some relevant forms of address and re - clarifies the distortion of relevant laws or regula tions. It considers that college undergraduates are eligible to be called as laborer in the sense of labor law, the employed students should be protected because of the labor relationship between them and the employing unit. Finally the paper promotes some related suggestions to reguahe the self - determined working behaviors of college undergraduates.
