| 摘 要： | 在人类已经步入新千年之际，生物基因工程技术的突飞猛进给人类社会带来空前机遇的同时，也提出了的挑战。在此背景下，文章着重研究了在知识产权法律框架下如何对生物基因进行法律保护的问题，通过比较分析版权保护与专利权保护，提出了以专利制度为基础以基因进行保护的观点。并阐述了基因专利保护所面临的问题及其对策。

| Abstract: | At the beginning of the new century, the rapid advance of gene engineering brings up not only a lot of opportunities but also a lot of new challenge. The paper discusses the legal protection of gene at the frame of intellectual property. Through the comparison of copyright protection and patent protection, it brings forward the opinion of patent protection to gene, and then the paper discusses the problems on the patent protection of gene and the solutions. |
