| 摘 要： | 人性化执法以人为主体和目的，以人权和人道为基本原则．将法律的教育功能和惩罚功能结合起来，追求执法公正与执法效果的统一。人性化执法的全面实施．既依赖于完善的人性化立法，又依赖于执法之“刚柔相济”，还依赖于明的执法理念。这是一项复杂的系统工程，需要长期而艰苦的努力。

| Abstract: | Enforcing the law on the basis of human nature means taking people as the subject and purpose, taking human rights and humanity as the basic principle, connecting the educational function and punishment function of law, and looking after the unity of enforcing law farely and the effect of enforcing law. The whole practice of enforcing law on the basis of human nature depends on making law, enforcing law with the methods of hard and soft, civilizing the idea of enforcing law. It is a complicated and systematic project, which needs long-time and hard efforts. |
