| 摘 要： | “共同行政行为”概念的出现与行政权力分权运作的体制上违背,无论对其作形式意义上的理解,还是实质意义上的界定,都会导致理论与实践中的混乱,因此应摒弃它,在立法、执法环节另寻其它理论支撑并进行相应的制度改进。

| Abstract: | The concept of "common administration behavior " conflicts with the system in which administration power operate individually. Whether it makes the meaning from the form or from the substance, it would put the theories and practice into confusion. So we should abandon it, look for other theories to prop up and proceed system improvement in the process of legislation and administration. |
