| 摘 要： | 错案是司法制度的代价，任何司法机制下都会产生错案，它具有客观性和普遍性，并不能从根本上消灭。但是通过研究刑事错案发生的原因和规律，可以最大限度防止错案发生。而且不仅要研究刑事错案的个案具体原因。更应该通过其研究背后的深层次原因。通过研究被告人i：r供与刑事错案的关系，警示在司法实践中过度重视依靠被告人口供所带来的司法“灾难”，旨在解决错误对待被告人口供形成刑事错案的问题。

| Abstract: | The misjudged criminal case is the cost of judicial system and will appear under any judicial system, which is of objectivity and universality and cannot be root out. However, through the study on the casues and rules of misjudged criminal cases, the appearance of misjudged criminal cases can be prevented to the maximized extent. Further- more, the cause of misjudged criminal cases should be explored and the underlying cause should be explored. Through the study on the relationship between the defendant~ confession and misjudged criminal cases, this paper warns about the judicial ＂disaster＂ because of excessive emphasis on the defendant~ confession in judicial practice, and aims to solve the problem of misjudged criminal cases caused by incorrectly treating the defendants confession. |
