| 摘 要： | 经济法与商法的关系问题不仅是法学理论研究较为混乱的课题,而且同时对商法、经济法的各自发展也产生了负面的影响.在现在社会关系复杂化综合化的影响下,部门法之间无法有泾渭分明的界限,彼此融合,相互衔接,交叉配合已是部门法之间的主要的关系.本文从二者的产生发展出发,承认二者的独立性,着重分析二者的衔接与交叉并融,研究二者在市场机制的变化发展中的配合与互补.
