| 摘 要： | 善意取得制度是物权法上的一个重要制度，我国《物权法》将不动产善意取得适用于善意取得制度中，对善意第三人的合法权益保护有非常积极的意义。但其立法语言过于简洁，对各个构成要件的内涵没有规定，造成了法律适用的困难。完善不动产善意取得制度，应尽快制定不动产管理法，建立统一登记机构体系，采取实质审察方法确立不动产登记，进一步细化不动产善意取得中“登记完成”，增加权利救济途径，建立登记公开制度。

| Abstract: | Good faith acquisition system is an important system in property law. The the property law in China applied the immovable property into good faith acquisition system has great positive significance in protecting the legal interests of the third faithful party. However, the legislative language of the law is very simple. The lacking of the detail of the various constitutive requirements leads to the difficulty to the application of the law. The perfection of good faith system of immovable property should concentrate on developing immovable property laws, setting up a unified registration system, using essential method to establish real estate registration requirement, further refining the real estate ＂registration completed＂ , increasing the right relief way and establishing registration open system. |
