| 摘 要： | 实定法并没有排除试题获得著作权法的保护。试题符合知识性、独创性和可复制性的特征,是著作权法上的作品。但是,从国家机关或法律法规授权组织的职能角度看,国家考试试题不宜获得著作权的保护。

| Abstract: | The present China’s law does not exclude the examination paper from the protection of Copyrights Law.The examination paper should be the works of the Copyrights Law given that it satisfies the characteristics of intellectuality,originality and being copiable.However,from the perspective of the powers of state government or the organizations empowered by laws or regulations,the paper of examination sponsored by the government or such organizations should not be protected by the Copyright Law. |
