| 摘 要： | 区分原则是我国物权法的基本原则之一，不仅有其自身的理论和实务意义，对于理解、把握我国民法中的善意取得制度也至关重要。需要指出的是，我国物权法第106条规定的善意取得规则与合同法第51条实际上并无实际联系，这是由以区分原则为基础所建立起来的民法财产法的结构体系所决定的，也是由处分行为与负担行为的区分所决定的。善意取得的理论基础是物权行为与债权行为的区分，它所适用的情形为无处分权的物权行为。无处分权的物权行为无效，但善意取得情形除外。善意取得作为对无处分权的物权行为无效机制的补充，形成了自身较为完善的体系。

| Abstract: | Distinguishing principle is one of the basic principles of real fight law. The connotation of it can be expressed as following： distinguishing juristic act of real fight from claiming behavior, evaluating the legal effect essentials of the juristic act independently, and abstracting the latter from the former. It has theoretical and practical significance for itself; meanwhile it is very important for grasping Bona Fide Acquisition. It is necessary to point out that the Bona Fide Acquisition enacted by article 106 of Real Right Law doesn＇t relate to the article 51 of Contract Law, which is determined by the distinguishing principle, especially by the distinction between the act of disposition and burden act, and the structure of our property law based on the distinguishing principle. Bona Fide Acquisition constructs its theoretical foundation on the distinction between juristic acts of real right and claiming behavior and suits itself for the condition of juristic act of real right being without right of disposition. The juristic act of real right is ineffective when one has no fight of disposition to do it, as the exception of which, Bona Fide Acquisition isn＇t affected by that. As the supplement of the rule that juristic act of real right without fight, Bona Fide Acquisition forms its quite perfect system consisted of objective Bona Fide and subjective Bona Fide, Bona Fide Acquisition of ownership and other rights and so on. |
