| 摘 要： | 思维方式是一个职业群体区别于其他群体的内在特征和根本标志。法律人的思维方式乃是以理性思维为基础,以法律思维为核心,以法学思维为先导的思维习惯或思维定势。在这一思维习惯中,理性思维、法律思维和法学思维三者之间既相互区别又相互渗透,并从理论与实践两个层面对法律人的行为模式及整个社会的法治建设产生着重大而深远的影响。法理学则应肩负起建立和培养整体性法学思维方式的使命。

| Abstract: | The thinking mode is the inner feature and basic sign that a professional group knows from the others.The thinking mode of the jurists or lawyers is a thinking habit or a thinking tendency which bases on the rational thinking,with legal thinking as core and jurisprudence thinking as guide.In this thinking habit,the rational thinking,the legal thinking and the Jurisprudence thinking distinguishes each other as well as permeates mutually.They produce on both theory and practice significant and profound influence to the action mode of jurists or lawyers and the rule of law in a society.The Jurisprudence should undertake the mission to establish and train the whole-thinking mode. |
