| 摘 要： | 在对中国刑事附带民事诉讼制度进行纵向比较研究的基础上,从诉的合并角度对中国附带民事诉讼模式进行了反思。作者对中国刑事附带民事诉讼制度的存在价值提出了质疑,认为该项诉讼制度必须适时改造,而最适合中国附带民事诉讼制度改造的路子是在坚持"选择审理模式"的前提下,建立"移送民庭审理制度",对应当纳入"移送民庭审理"的案件范围,建议采取列举式和概括式相结合的立法技术,在刑事诉讼法的再修改中作出明确规定。

| Abstract: | This paper reflects on the mode of Chinese civil suit collateral to criminal proceedings from the standpoint of the combination of lawsuit on the basis of longitudinal comparative study of the system of Chinese civil suit collateral to criminal proceedings.The author puts forward his query about the value for the existing of the system of the Chinese civil suit collateral to criminal proceedings and believes that this procedural regime should be reformed at a very convenient time.Moreover he also believes that the methods that most suit the reform of the Chinese civil suit collateral to criminal proceedings are to establish" the system of sending cases to civil court to be judged"on the recondition of insisting"choosing the mode of cognizance"and to adopt the lawmaking technology that combines the listing and summarization and make specific stipulations in the further revision of the law of the criminal procedure about the cases that should be included in the range of sending cases to civil court. |
