| 摘 要： | 合同债权的转让是我国合同转让制度中新的规定 ,已为统一的《合同法》所确立。参考国外民事立法的有益经验 ,吸收国内专家学者相关的理论 ,由此来分析合同债权转让的特征和要件 ,对于完善这一法律制度 ,准确地理解这一法律制度 ,具有十分重要的意义。

| Abstract: | The contract creditor's rights transfer is a new stipulation in the contract transfer system, and has been established in the unified Contract Law. Making reference to the civil legislation experience in other countries and the domestic experts' theories concerning this system, and analyzing the legal characters and necessary conditions in transferring the contract creditor's rights are of importance to perfect and to accuritely understand this legal system. |
