| 摘 要： | 大学校长作为高等学校的法定代表人对高校管理具有重要的现实意义，而目前的研究对此认识不足，把法定代表人错误地等同为法人代表，无疑降低了大学校长的管理责任。大学校长法律地位的实现对大学的发展具有重要意义，而大学法人地位、大学办学自主权、大学内部管理体制以及大学学术性事务管理等因素对大学校长法律地位都有着重要影响。为保证大学校长法律地位的实现，应该加强相关的法规建设、大学规章制度建设以及大学管理制度建设。

| Abstract: | As a legal representative, the president plays a great role in the management of university. But present researches haven't realized its importance and misconceived the difference between legal representative and legal person, thus caused insufficient understand of president's legal status. As we know, the president is important for the development of university. At the same time, the legal person position of university, the decision making right of running university, the administrative system in university and the academic management impact on the status of president. The legal status of the president should be strengthened from three aspects, i.e. the law, the university system and administration. |
