| 摘 要： | 保险人需明确说明的"免除保险人责任的条款"应包括免除或者限制保险人责任的条款,其并不局限于保险合同中约定的"除外责任"条款;投保人已知或应知的免除或者限制保险人责任的免责条款,即便保险人未明确说明,也不应导致该条款不生效力。

| Abstract: | The clause provides for the exemption of liabilities for the insurer perfectly or partly should be stated clearly before singing the insurance contract according to the insurance law,and they include all the clause provides for the exemption of liabilities for the insurer besides the clause named "liability exemption".If the insurant has knew or should known,even insurer doesn't clearly state it,the clause is still binding. |
