| 摘 要： | 我国作为大体沿袭大陆法系立法的国家,在信托法与物权法的衔接上存在着物权请求权的唯一性与对受益人保护的衡平这二者之间的矛盾。其解决方式就是确定信托财产上物权请求权的归属以及给予非信托财产所有权人以物权的保护方式。

| Abstract: | As a nation which mainly follows Continental Legal System,our country has a contradiction between the uniqueness of the claim of real rights and the equity for trust beneficiary in the field of connecting Trust Law and Real Property Law.Two of the solutions are determining the belonging of claim of real rights on trust property and attribute the protection model of rights in rem to the trustor and beneficiary. |
