| 摘 要： | 论述商法部门独立地位的文献很多，但大都是采取法部门划分标准这一工具。以商法的历史发展为脉络，将会使我们更直观地看到商法地位的变迁一一从绝对的独立地位到其绝对独立地位的丧失，以及民法与商法之间关系的交锋与互动，地位上的此消彼涨与相互抗衡。我们将试着解释这种变迁及民法商法之间的关系，并得出商法是独立法部门的结论．

| Abstract: | There are a lot of the documents on the expression of the statue of the commercial law department, but all adopt the tool of the divisions of it mostly. On the aspect of the historical development of the commercial law, we will see the changes of the commercial law statue more ocularly from the absolute statue to the losing of the absolute statue,and the Cross Swords and the interaction between the Civil Law and Commercial Law, and the changes of their statue and the interaction between them. We get a couclusion that the commercial law is an independent law department which best explains the relation between this kind of changes and civil law and commercial law. |
