| 摘 要： | 产权清晰是构成真正的合格的市场主体的首要条件，高校——尤其是民办高校也不例外。根据产权理论，产权清晰有三层法律含义和四项构成要件。依此来衡量我国现行法律体系对民办高校产权的规范，至少有三个方面是不清晰的。应从对教育公益性的认识、借鉴经济改革成功的经验和我国与WTO接轨等三个方面来思考明晰民办高校产权问题。

| Abstract: | Property right distinction is the first premise of the formation of the main body of market, especially for nongovernment colleges and universities. On the base of property right theory, property right distinction includes three kinds of different law meanings and four parts. There are three feasible methods, including public welfare of education, the experiment of economy reforming and the entrance of World Trade Organization, for the problem of non-government colleges and universities＇s property right distinction. |
