| 摘 要： | 无论在我国现行立法上还是目前理论界，关于保证期间的性质一直处于在除斥期间和诉讼时效之间徘徊不定的状况，笔认为它既不是诉讼时效，也不是除斥期间，而是独立于除斥期间和诉讼时效之外的失权期间。
