| 摘 要： | 对相关地区的命名是国家主权行使的具体表现,反映了国家对地方的管辖。南海诸岛及其海域的命名,自有其历史演变的过程和特征,在某种程度上反映国家对南海管辖逐步而具体的历程。清末李准命名西沙诸岛之前,对南海的称呼虽始终没有形成官方统一标准,但当与各种军政管辖行为相结合时,可以确认为初始的领有关系和原始权利。20世纪以来的四次标准化命名,则不断在西方主权概念下从根本上确认了中国对南海的管辖权和主权。历史至今,对南海的命名均是中国进行有效管辖的具体反映,具有不容置疑的国际法效力。

| Abstract: | The naming of a relevant region is a concrete manifestation of exercising the sovereign power,which reflects the national jurisdiction of the region. The naming of South China Sea islands and their waters has its own historical evolution process and features,which mirrors the gradually in-depth and specific process of China＇s jurisdiction of the South China Sea to some degree. Prior to Li Zhun＇s naming of Xisha islands in the late Qing Dynasty,some sort of initial ownership and original rights could be identified in combination with various military and administrative jurisdiction despite the shortage of official unified norms on the appellation of the South China Sea all the time. The four standardization reforms on the appellation of the South China Sea since the 20th century has fundamentally confirmed China＇s jurisdiction right and sovereignty of the South China Sea under the concept of the Western sovereignty. So far,China＇s naming of the South China Sea has represented China＇s effective jurisdiction of the South China Sea,which has a conclusive force of the international law. |
