| 摘 要： | “亲亲相隐”绵延千年历史，中外法律制度皆然。新中国成立后，该制度作为封建糟粕而被刑事法律抛弃。在梳理该制度历史脉络的基础上，对其普适性价值进行论证，并进而对其创造性转换提出建议，将有利于社会主义和谐社会和法治社会的建立。

| Abstract: | ＂ Mutual Concealing between Relatives＂ has been last for more than a thousand years in both Chinese and foreign legal systems . After the founding of new China, this system was abandoned by the criminal law as a feudal dross. This article tries to study the development of this system and to demonstrate the universal value of the concept. It also tries to explain how to realize the transformation of the legal concept. The purpose is to build a harmonious socialist society and the construction of the rule of law. |
