| 摘 要： | 伴随着跨国公司在中国市场上利用知识产权优势加强其竞争地位的过程,一些涉嫌滥用知识产权的行为也不同程度地表现出来了,并且往往与限制竞争或者垄断行为联系在一起。这尤其突出地表现为拒绝许可、搭售、价格歧视、掠夺性定价、过高定价等。我国急需建立和完善以反垄断法为核心的规制,包括跨国公司在内的知识产权滥用的法律制度

| Abstract: | With the transnational corporations' enhancing their competitive power by making use of the advantages of intellectual property rights in China's markets,some behaviors which abuse intellectual property rights emerge.And,they always have some relationship with restrict competition or monopoly,This is especially outstanding in the fields of refusing permission,pairing,price discrimination,fixing a price imperatively,fixing an excessive price.Our country needs setting up and improving the regulations whose core is anti-monopoly law,including the abused intellectual property rights restricting transnational corporations. |
