| 摘 要： | 近年来,博客侵权案件不断增多,由于我国尚未对博客问题作出专门的立法规定,在发生博客侵权案件时,经常在性质认定、责任承担等方面发生严重分歧。这对于依法规范博客行为、保护当事人的合法权益、惩治违法行为人等都产生了不良影响。探讨博客侵权的构成要件,对博客侵权及其立法规制将有所裨益。

| Abstract: | In recent years,the blog infringement cases has been increasing.As China has not established the legislative provisions for Blog issue,so it is necessary for people to find out the nature of the cases and the responsibility to bear for the parties concerned.This has influenced the protection of the legal rights and interests of litigants and the punishment of the actor of tort.This paper discusses the elements to form the act of tort for blog writing and the legislation of act of tort issue. |
