| 摘 要： | 重婚罪中的“配偶”、“与他人同居”如何理解；前一婚姻关系无效是否会构成重婚；重婚罪受害人如何启动司法救济程序等问题，关系到重婚罪的法律适用，但在实践中争议较大。为此，有必要在理论上作进一步的探讨。
