| 摘 要： | 与世界主要国家和地区对配偶继承权保护相比较，我国现行继承法已日益难以适应社会经济的快速发展、家庭结构的巨大变迁及家庭财产的急剧变化，不能充分保护配偶继承权益，其不足之处已愈发突显。未来继承法应根据配偶权保护日益加强的国际立法趋势及我国现实生活的需要，对配偶继承的顺序、继承份额及时作出修改；增设生存配偶的先取权、用益权、特留份等制度，实现对配偶权的周到保护。

| Abstract: | Compared with the spouse inheritance protection of the world＇s major countries and regions, China＇s current law of succession has been increasingly difficult to adapt to the rapid changes in the rapid development of social economy, the great chan- ges of family structure and family property, can not fully protect the rights and interests of spouse inheritance, its shortcomings have been increasingly highlight. Future inheritance law should be based on the trend of international protection legislation which the right of spouse is increasingly strengthened and China＇s reality life need, the order of spouse inheritance, inheritance share should be timely modified; the first right, usufruct, special portion system should be added to realize the spouse right protect. |
