| 摘 要： | 2002年9月1日，国务院发布的《医疗事故处理条例》正式施行，增加了关于患者知情权的规定。本文从现行立法的有关规定谈起，浅析知情权的范围、医疗机构的告知义务及应承担的责任，进而对最能体现知情权的病历和手术同意书问题进行了分析并提出了一些自己的看法，试图对患者知情权有进一步的认识，在实践中更充分地保护患者的知情权，建立良好的医患关系，有效预防医疗纠纷的产生，保护患者的合法权益。

On the Well-informed Rights of Patient |

| Abstract: | On September 1,2002, State Department announces The Regulation of Solutions on Medical Treatment Accident. It regulates the well-informed rights of patient. This article firstly comments on the current legislation and relevant provision, and analyses the scope of patient well-informed rights and the duties of medical treatment organization, then to discuss the medical history and surgical operation approval book. Finally the authors also put forward some own viewpoint, and try to further know the cognition of well-informed rights, to protect more adequately the rights of patient in practice, to establish goodly relations between the doctor and patient, to validly prevent medical treatment dispute, to protect the sufferer's legal rights. |
