| 摘 要： | “作证难”是困扰我国司法实践的一个难题,导致“作证难”的原因有很多,而忽视证人的经济利益就是其中很重要的一个方面。本文由“作证费”现象引出证人经济补偿制度,从经济学和法理的角度对证人经济补偿制度的理论基础展开论述,并基于我国现行立法中对证人经济补偿规定的欠缺及其存在的问题,从证人经济补偿的接收主体、费用承担者、范围和标准以及程序设置四个方面谈一下我国证人经济补偿制度的构建。

| Abstract: | It is hard for people to witness before the count,and the witness is a big problem in our judicial practice.There are many reasons.One of them is neglecting the economic benefit of the witness.This article,which origins from "the expense for the witness",is about the witness economic compensation system.From the view of economy and jurisprudence,this article is considering the theoretical basis of the witness economic compensation system.Being lack of the legislation of it and being of many problems in the legislation,this article also discusses the construction of this system from the view of the receivable subject,the assumer,the scope,and the standard and the setting procedure. |
