| 摘 要： | 我国刑法在赌博行为的犯罪构成设计和刑罚体系设置方面存在缺陷。对赌博犯罪的犯罪客体和对象存在理解上的偏差;对赌博犯罪罪状归纳不合理,对擅自发行、销售彩票的犯罪行为定性不当,没有规定强迫赌博罪;在主观立法方面也存在不足。应提高赌博犯罪的法定刑期,扩大量刑幅度,明确罚金比例和标准,加重罚金刑的应用。

| Abstract: | In criminal law deficiencies exist in design of crime composition and establishment of punishment system,which shows irrationlity in comprehension in subject and target of crime,generalization of charges in indictment,cognizance in illegally issuing and selling the lottery ticket and punishment for a compulsive gamble,as well as subject and subjective aspects of crime.To perfect the punishment system measures lie in reconstructing the charge of crime of gamble,cumulating the term of penalty and defining the proportion and standard of the monetary penalty to practice it. |
