| 摘 要： | 成本是影响纠纷解决绩效的重要因素.我国现有的环境纠纷解决机制在成本交易方面存在不足.仲裁以其较低的交易成本成为可选择的环境纠纷解决机制之一,在制度设计上应立足于控制交易成本,就环境纠纷的可仲裁性、仲裁协议、仲裁制度等基本问题进行考量.

| Abstract: | The effect of dispute settlement mechanism depends on its transaction costs,but deficiencies existed in the current environmental dispute resolution mechanism.With lower transaction cost arbitration becomes an alternative environmental dispute resolution mechanism,in system design we should based on the control of transaction costs to consider the arbitrament of environmental dispute,arbitration agreement,arbitration system and other basic issues. |
